1. Agreement to These Legal Terms

By accessing or using SWAPP, you agree to comply with these legal terms and any additional policies referenced on this page. If you are using SWAPP on behalf of a church, nonprofit, ministry, or other organization, you represent that you are authorized to accept these terms for that entity. If you do not agree with any part of these terms, you should discontinue use of the platform and related services.

Authorized Users

Account administrators are responsible for ensuring that team members, volunteers, and staff are properly permitted to access SWAPP data and tools.

Binding Acceptance

Continued use of the platform after updates to our legal terms constitutes acceptance of the revised version as published.

Account Responsibility

You are responsible for maintaining the confidentiality of credentials and for activity performed under your account.

2. Permitted and Prohibited Use

SWAPP is intended for lawful ministry, organizational communication, member engagement, internal administration, and community support. You agree not to use the platform in any way that violates applicable laws, infringes on the rights of others, or compromises the security, integrity, or availability of the service.

Examples of Allowed Use

Managing congregational communications, publishing events, sending service reminders, organizing follow-up workflows, tracking giving, and coordinating ministry operations.

Examples of Prohibited Use

Uploading malicious code, attempting unauthorized access, sending unlawful or deceptive messages, scraping data without permission, or misusing content and branding.

3. Intellectual Property Rights

All software, interfaces, text, graphics, logos, product names, and design elements associated with SWAPP are protected by intellectual property laws and remain the property of SWAPP or its licensors. Unless expressly authorized in writing, you may not copy, modify, distribute, publicly display, reverse engineer, or create derivative works based on the platform or its content.

Brand and Content Usage

Churches and organizations may use SWAPP to publish their own messages and materials within the platform, but that does not transfer ownership of SWAPP software, trademarks, or proprietary components. If you submit feedback, suggestions, or improvements, you grant us a non-exclusive right to use that input to improve our products and services without obligation to compensate you.

4. Third-Party Services and Integrations

SWAPP may connect with third-party tools, payment processors, analytics providers, communication services, hosting environments, or external platforms. These services are governed by their own terms and privacy policies. We do not control the policies, performance, security practices, or availability of those external providers.

Operational Dependencies

Some features may rely on third-party networks or APIs. Delays, outages, or configuration changes outside our control can affect performance.

Separate Terms May Apply

When you click through to an external service, your use of that service is subject to the provider’s own legal terms and privacy practices.

Payment Processing

If payments or donations are enabled, transaction processing may be performed by third-party payment platforms that maintain their own compliance obligations.

5. Data Handling, Confidentiality, and Security

We take data stewardship seriously. Because SWAPP is used by churches and ministry teams to manage communication and organizational records, protecting sensitive information is a top priority. While no system can guarantee absolute security, we implement reasonable administrative, technical, and organizational safeguards designed to help protect platform data.

Users should avoid sharing credentials, limit access to authorized personnel, review permissions regularly, and promptly notify support if unauthorized activity is suspected. Organizations remain responsible for the content they upload, collect, store, or distribute through their own use of SWAPP.

Security Best Practices

Use strong passwords, enable role-based access where available, review user permissions, and train staff on safe handling of member and donor information.

Organization Responsibility

Your church or organization is responsible for ensuring that the data you collect and the messages you send comply with applicable laws, regulations, and internal policies.

6. Service Availability and Changes

We may update, suspend, discontinue, or modify any part of SWAPP at any time to improve functionality, address maintenance needs, ensure security, or comply with legal obligations. Although we strive for dependable service, availability may be interrupted by scheduled maintenance, emergency repairs, connectivity issues, or events outside our control.

No Guaranteed Uptime

We do not warrant uninterrupted or error-free access. Features, interfaces, and integrations may be changed from time to time without prior notice where permitted by law.

7. Disclaimer of Warranties

SWAPP and all related content are provided on an "as is" and "as available" basis to the maximum extent permitted by law. We make no express or implied warranties regarding merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. You assume responsibility for how you evaluate and use the platform in your own environment.

8. Limitation of Liability

To the fullest extent permitted by law, SWAPP, its owners, affiliates, employees, and partners will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the service. This includes, without limitation, loss of data, lost revenue, business interruption, reputational harm, or system-related delays.

Risk Allocation

Our liability limitations are intended to reflect the practical realities of software delivery, hosting dependencies, and customer-controlled usage patterns. Some jurisdictions may not allow certain limitations, so these provisions may apply only to the extent allowed by applicable law.

9. Indemnification

You agree to defend, indemnify, and hold harmless SWAPP from claims, losses, liabilities, damages, costs, and expenses arising out of your use of the platform, your violation of these terms, your violation of any rights of another party, or content and data you submit through the service.

10. Governing Law and Dispute Handling

These legal terms are governed by the laws applicable to the jurisdiction where SWAPP is operated, unless a different governing law is required by contract or statute. If a dispute arises, the parties should first attempt to resolve the matter informally and in good faith before pursuing formal legal remedies.

Informal Resolution

Before filing a claim, contact us so we can investigate the issue and attempt a practical resolution whenever possible.

Severability

If any portion of these terms is found unenforceable, the remaining provisions will continue in full force and effect.

Updates to Terms

We may revise these legal terms periodically. The most current version will govern your use of the website and platform.
